Charged with Dangerous Driving?
In this video, Conor Johnstone (Senior Motoring Defence Solicitor) provides an overview of the options available to individuals charged with dangerous driving. Dangerous driving is considered a serious offence, often leading to custodial sentences or lengthy driving disqualifications. There are three main options for someone charged with this offence. http://www.majlaw.co.uk For free initial advice call: 01514228020 Email: [email protected] Guilty Plea: This is the most common approach, where a person pleads guilty to the charges. Benefits include receiving "maximum credit" (a reduction in the punitive part of the sentence, like financial penalties or prison time), but it won't reduce the mandatory driving ban or the requirement for an extended driving test. Not Guilty Plea: This option involves challenging the charges, allowing the defendant to review the evidence and potentially find weaknesses in the prosecution's case. The case may go to trial in the Crown Court, where the acquittal rate is higher compared to the Magistrates' Court. Even if convicted later, the defendant can still negotiate a reduced sentence based on the facts of the case. Negotiating a Lesser Offence (Careless Driving): If the driving wasn't "dangerous" but could be classified as "careless," the defendant might negotiate a plea to a lesser offence. Careless driving carries lighter penalties, including shorter disqualifications and no mandatory extended retest. The prosecution may accept a guilty plea to careless driving, reducing the chances of prison time and other severe penalties. The video stresses the importance of seeking expert legal advice before making a decision, as the consequences of a dangerous driving conviction can be severe. It also mentions the possibility of negotiating with police or the CPS before charges are formalised, possibly reducing the charge to careless driving.
