RERA Law and RERA Rules and Real Estate Regulation Act Explained in Details in English RERA law was enacted in 2016 and then implemented under which the State governements are under obligation to create RERA authorities and regulate the real estate projects falling within their state. RERA law mandates the registration of every project where more than 8 units are being constructed or more than 8 units of plots are being sold. The Real Estate (Regulation and Development) Act, 2016 (RERA) is a legislation enacted by the Indian Parliament to regulate the real estate sector in India. The main objective of RERA is to protect the interests of homebuyers and to promote transparency and accountability in the real estate sector. Under RERA, every state and union territory in India is required to establish a Real Estate Regulatory Authority (RERA) to regulate the real estate sector in that region. RERA has provisions for mandatory registration of all new and ongoing real estate projects with the regulatory authority, and for the disclosure of project details such as project plans, layout, completion schedule, and approvals. Developers are required to deposit a certain percentage of the project cost in an escrow account to ensure that the funds are used only for the construction of that project. RERA also mandates that developers cannot make any changes to the project plan without the consent of at least two-thirds of the homebuyers, and that developers are liable for any structural defects or quality issues that arise within five years of the possession of the property. RERA has brought in a lot of transparency and accountability in the real estate sector, which was previously known for its lack of transparency and customer complaints.
