This course offers a comprehensive exploration of differential approaches and ethnic diversity within the context of Colombian law. Throughout the program, we will examine how the Colombian legal system adapts to the country's cultural and ethnic diversity and protects the rights of ethnic and indigenous communities. We will analyze everything from how differential approaches are addressed in Colombian law to how conflicts between different legal bodies are resolved. In this course, we will explore three conceptual models for understanding the concept of identity and its relationship to ethnic and cultural diversity. We will also study the regulations related to ethnic communities and peoples in Colombia, from before the 1991 Constitution to current legislation, including the Constitutional Bloc and the Peace Accords. We will delve into the conceptualization of ethnic diversity from the perspective of Colombian constitutional jurisprudence and analyze how ethnic communities resolve community conflicts and develop their own legal systems. We will also study the various ways in which constitutional jurisprudence has conceptualized due process within the context of special indigenous jurisdiction.
