In this video I have discussed that - Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita (BNSS) essentially states that when a police officer has reasonable suspicion that someone has committed a cognizable offense, but does not need to arrest them immediately, they can issue a notice directing the person to appear before them at a specified time and place instead of making an arrest; the individual is then required to comply with the terms of the notice; if they fail to do so, the police officer can then arrest them. Key points about Section 35(3) BNSS: No mandatory arrest: If a police officer has reasonable suspicion but does not need to immediately arrest someone, they can issue a notice instead. Compulsory appearance: The person receiving the notice is obligated to appear before the police officer at the specified time and place.
