Article 34. Superficial check 1. A superficial check as a preventive police measure is a visual inspection of a person, running a hand, a special device or tool over the surface of the person's clothing, a visual inspection of an item or vehicle. 2. A police officer may stop and/or search persons to perform a cursory identity check if there are sufficient grounds to believe that the person is carrying an item whose circulation is prohibited or restricted or which poses a threat to the life or health of the person or other persons. 3. A cursory check shall be performed by a police officer of the corresponding gender. In urgent cases, a cursory check may be performed by any police officer only with the use of a special device or means. 4. A police officer may perform a cursory check of an item or vehicle: 1) if there are sufficient grounds to believe that the vehicle contains an offender or a person whose freedom is being illegally restricted; 2) if there are sufficient grounds to believe that the vehicle contains an item whose circulation is prohibited or restricted or which poses a threat to the life or health of the person or other persons; 3) if there are sufficient grounds to believe that the item or vehicle is an instrument used to commit an offense and/or is located in a place where a criminal offense may be committed, for the prevention of which it is necessary to conduct a superficial inspection. 5. A superficial inspection of an item or vehicle is carried out by visually inspecting the item and/or vehicle or visually inspecting the interior and trunk of the vehicle. When conducting a superficial inspection, the police officer has the right to demand that the trunk lid and/or interior doors be opened. 6. When conducting a superficial inspection of an item or vehicle, the person must independently show the police officer the contents of their personal belongings or vehicle. 7. If any traces of an offense are detected during a superficial inspection, the police officer ensures their safety and inspection in accordance with the requirements of Article 237 of the Criminal Procedure Code of Ukraine.
