🚨 Supreme Court Acquits Father in Minor Son’s Poisoning Case In this important criminal judgment, the Supreme Court of Pakistan set aside the death sentence awarded to a father accused of poisoning his four-year-old son. The Court carefully reappraised the evidence and found that the prosecution case suffered from serious legal defects. The alleged eyewitnesses were treated as chance witnesses because they failed to give a convincing reason for their presence at the place of occurrence. Their testimony was found inconsistent regarding their arrival, mode of travel, and material facts. The Court also noted their unnatural conduct: despite claiming that poison was administered from a glass brought from a room, they neither checked the glass nor inspected the room. The FIR was lodged after considerable delay, although the witnesses were allegedly present at the hospital. The Court further noticed material improvements regarding the alleged steel glass. Most importantly, the mother of the deceased admitted that pesticide was ordinarily kept in the house due to agricultural work, and the medical officer conceded that a four-year-old child could consume poison by mistake, being unable to distinguish poison from a drink. The Supreme Court held that this created a reasonable hypothesis of accidental ingestion. In the absence of motive, strained relations, or any compelling evidence, it was inherently improbable that a father would poison his own minor son in the presence of relatives.
