»AfD-Verbot – was nötig und was möglich ist«

Carolin Emcke in conversation with Bijan Moini (lawyer and political scientist) The debate surrounding a potential ban on the AfD (Alternative for Germany) party is at a standstill. Why? What material, what evidence exists that could serve as a basis for pursuing a ban? What information does the Federal Office for the Protection of the Constitution (Germany's domestic intelligence agency) provide, and what do the state offices offer? How realistic are the chances of success? What are the political or legal obstacles? BIJAN MOINI (born 1984 near Karlsruhe) is a lawyer, political scientist, author, and civil rights activist with German-Iranian roots. After earning his doctorate in Hamburg and completing his legal traineeship in Berlin and Hong Kong, he worked as a lawyer for a commercial law firm. His award-winning novels "Der Würfel" (The Cube) and "2033" were published in 2019 and 2025, respectively, both by Atrium Verlag. Today, he works for the Society for Civil Rights and heads its legal team. He has already appeared before the Federal Constitutional Court several times and, since spring 2025, has been leading the preparation of a major expert opinion on the question of whether the AfD is unconstitutional and could be banned.
