ELECTRONIC VOTING IN WORKS COUNCIL ELECTIONS: What You Risk and How to Protect Your Rights The CNIL (French Data Protection Authority) has just published a new recommendation to regulate electronic voting for Works Council elections. Indeed, this practice is becoming increasingly widespread because it is practical, quick, and reliable. It doesn't require spending long hours counting votes and allows employees to vote remotely and conveniently. However, this practice also presents risks regarding the security of the vote: respecting the secrecy of the vote (no one should know who you voted for) and respecting the integrity of the ballot (the electronic system must not alter your vote). These are fundamental rights. Furthermore, the employer must comply with the GDPR when handling your personal data: its confidentiality must be guaranteed. Therefore, employers have numerous obligations regarding electronic voting: it must be included in the Pre-Election Protocol (PAP) negotiated by the unions; The service provider must guarantee a level of security commensurate with the risk level of the election, which must be assessed on a scale of 1 to 3; an IT expert must be able to audit the system to ensure its compliance with regulations. These are all obligations that fall on the employer, as well as the resources available to your employee representatives (Works Council and unions), not to mention your rights as citizens, which I detail in this video.
