On New Year's Day, a man sat in his PARKED car — engine on for heat, looking at his phone, not driving because he'd been drinking — and a police officer pulled him out and charged him with DUI. On cross-examination, the arresting officer admitted he never saw the car move "at any point," never checked what gear it was in, and couldn't remember the man's phone, his still-open bar tab, or the arcade tokens in his pocket — only that he seemed intoxicated. The second officer confirmed the same holes. The judge found the car was legally parked, that the man had been sitting there several minutes using his phone, and ruled there was NO probable cause for the DUI. The DUI was dismissed; the entire case was ultimately dismissed in full.
