The sale or alteration of stolen goods gives rise to numerous subsequent claims. Besides the principles of unauthorized management of affairs and tort law, claims based on unjust enrichment under Sections 816 and 951 of the German Civil Code (BGB) must be examined. Because the extinguished right to restitution under Section 985 BGB continues in these cases (claim for continued legal effect), the preclusive effect of the law of unjust enrichment does not apply here.
