In the name of God, the Most Gracious, the Most Merciful: Dear brothers and colleagues, here are two lectures on Clause 5 of the FIDIC 2017 Yellow Book – Design. We will take a two-week break to prepare the second set of clauses, 6-10, and to allow you to review the first five. Clause 5 is the core of the design-build contract. It transfers full design responsibility to the contractor, while giving the owner (through the engineer) the right to review the contractor's documentation to ensure compliance with their requirements. However, the engineer's approval does not absolve the contractor of responsibility for design errors. A smart contractor scrutinizes the owner's requirements early, submits their documentation on time, and ensures that as-built records and O&M manuals are accurate and complete. A wise owner sets clear requirements, allocates sufficient time for review, and invests in training their staff. A final reminder: Good design alone is not enough; it must be properly documented. As-built records and O&M manuals are what remain after the contract ends and affect the contractor's reputation for years to come.
