Due to the coronavirus pandemic, vacation rentals and houses in Mallorca are increasingly becoming vacant. Occupiers are taking advantage of this situation to occupy other people's properties. While this behavior is clearly punishable in Germany and eviction could be obtained relatively quickly, the legal situation in Spain is fundamentally different. Spain's left-wing government passed new laws in 2021 that represent a slap in the face for property owners in Mallorca and throughout Spain. In Spain, Article 47 of the Constitution grants every resident the right to decent and adequate housing. Squatters throughout Spain invoke this article when they feel threatened with eviction. Until 2020, Spanish law stipulated that the police could only carry out the immediate eviction of a property within 48 hours of the occupation. After this period had expired, the court granted the squatters the right to remain. As mafia-like structures emerged over time, discovering this legal loophole as a business model, the Spanish government enacted new laws several years ago. Current legal situation regarding squatting in Mallorca in 2020 Owners breathed a sigh of relief: The new law stipulated that the police and the Guardia Civil could end a squat in Mallorca at any time as soon as squatters could not provide proof of their legal presence in a property. It only had to be proven that access to the property was due to an unauthorized act. The 48-hour deadline no longer applied. Vacation homes and remote houses were particularly affected by squatting. For many, the long-awaited vacation in their own vacation home in Mallorca began and ended with the realization that the locks had been changed and the property would be unusable for an indefinite period. Due to the increasing impoverishment and unemployment in the country caused by the coronavirus pandemic, the Spanish left-wing government has passed new regulations for dealing with squatting. The new law stipulates the following: It is no longer sufficient for squatters to have gained access through an unlawful act to trigger a police eviction. Since January 2021, eviction is only possible if the squatters have gained access to the living space through violence or intimidation. Otherwise, it must be guaranteed that the uninvited residents receive suitable alternative accommodation from social housing. Before this happens, the police cannot evict them from their apartment or house. This regulation makes it much easier for criminal gangs to squat in Mallorca and throughout Spain. One of the duties of a government is to protect the private property of individuals. Given the new regulations, it is questionable to what extent Spain's government still adheres to this principle.
