In what situations can a defendant be acquitted in a criminal proceeding? Today I will talk about the situations that lead to the acquittal of the defendant, in a very short and to-the-point explanation. An acquittal is a judicial decision made by the Judge who recognizes that a certain accusation or criminal complaint against someone is unfounded. A judgment of inadmissibility occurs when the judge decides that the request is not valid, and therefore it is UNFOUNDED. This is when the judge does not grant any of the requests of the person who filed the lawsuit. In criminal proceedings, the person who initiates the criminal action is the Prosecutor (a member of the Public Prosecutor's Office), through a complaint, or the victim himself, through a criminal complaint (when applicable). Then the judge will summon the defendant (he will issue a summons), which is to inform the defendant that there is a lawsuit against him. And then he can present his defense. After that, the judge will observe what evidence was presented in the case. The judge analyzes the evidence to form his conviction about the case. And, in the end, the judge must say, in the sentence, whether the defendant will be convicted or acquitted. The grounds for acquittal are in article 386 of the Code of Criminal Procedure. One of the grounds for acquittal is when it is proven that the fact did not exist (i.e., the crime did not happen). Another ground for acquittal is when there is no proof that the defendant was involved in the crime. Another ground for acquittal is when there is insufficient evidence for conviction. Think about it: for someone to be convicted, the evidence needs to be robust. In criminal law, there is the principle of presumption of innocence, or non-guilt. When in doubt, it is better to acquit than to run the risk of convicting an innocent person. Finally, there are also circumstances that exclude the crime or exempt the defendant from punishment. In other words: the fact existed, but, for some reason, the defendant will not be convicted (or will not serve his sentence). The most famous example is that of self-defense. It is not considered a crime when someone acts in self-defense to defend themselves from an attack. So they will be acquitted. This is a brief summary of acquittal, with the most important information for you to understand when a defendant is acquitted.
