Jerome Oziel had been accused by a state panel of breaking confidentiality rules and having sex with female patients, *he surrendered his license to the California Department of Consumer Affairs' Board of Psychology in 1997*. As part of the deal, Oziel admitted no wrongdoing. Oziel agreed to the arrangement because he no longer lived in California at the time and had not practiced psychology for a few years prior. According to his attorney, Bradley W. Brunon. Oziel became an expert in phobias of various sorts but, as he related in court, the majority of his professional articles dealt with sex-related disorders. When Oziel started seeing Erik Menendez in 1988 , his license was probationary because the state Board of Psychology had found he engaged in an improper "dual relationship." In July 1993, just a few days before Oziel took the stand for the prosecution in the Menendez trial, the state board alleged that he had allowed his mistress Judalon Smyth to surreptitiously listen in on his therapy sessions with the Menendez brothers. It also alleged that he was willing to allow her to audiotape sessions he had with the Menendez brothers and make copies of those tapes, and that he improperly gave her prescription drugs and assaulted her. The state board further accused Oziel of engaging in a sexual relationship with another woman who served as a babysitter, of improperly giving her prescription medicine and of assaulting her. At the second Menendez trial, prosecutors did not put Oziel on the stand.
