The elephant's foot plant is one of the most popular ornamental plants in Mexico, but few know that it is also a protected species. In some cases, failure to prove its legal origin can result in fines of up to 50,000 UMAs (Units of Measurement and Update) – equivalent to more than 6 million pesos – and even prison sentences of up to nine years, depending on the conduct under investigation and the determination of the authorities. The reason is that several species of the genus Beaucarnea, commonly known as elephant's foot, are listed in NOM-059-SEMARNAT-2010 as being in some category of risk due to illegal extraction and habitat loss. The Federal Attorney for Environmental Protection (Profepa) and the Ministry of Environment and Natural Resources (Semarnat) have intensified operations to combat its illegal trade and verify that those who sell or possess them can demonstrate their legal origin with the corresponding documentation. It is important to clarify that owning an elephant's foot plant is not, in itself, a crime. The problem arises when the plant was illegally harvested or sold, or when its origin cannot be proven with documentation issued by a nursery or authorized establishment. Therefore, authorities recommend always keeping the receipt or proof of purchase.
