The now-separated couple would frequently skip visits for several months at a time. They would go on separate journeys. Erika adored the opulent lifestyle Tom provided for her. In December 2020, Erika and Tom were served with a lawsuit accusing them of embezzling compensation money meant to aid the relatives of Lion Air Flight 610 victims. The class action law firm Edelson PC stated in court records that the divorce of the separated couple is a charade meant to deceitfully safeguard #tomgirardi and Erika's money and that they are on the edge of bankruptcy and trapped in a downward cycle of growing debts and shrinking cash. Tom and Erika did not respond to the accusations right away. According to court filings, Erika asked Tom for spousal support in November 2020 and stated that their separation was due to their "irreconcilable differences." She also sought that the court prevent her estranged spouse from requesting spousal support from her and ordered Tom to pay her legal bills. However, Tom asked the court to stop being able to grant Erika spousal support. She was also required to cover his legal expenses. In September 2020, Tom admitted to the court that his personal bank account had only a few thousand dollars and that his multi-million dollar stock portfolio was completely depleted.
