3 Words Missing From Your VA Letter Are Worth $311,000

On February 4, 2026 the U.S. Court of Appeals for the Federal Circuit killed the VA's implicit denial doctrine, and it means that if your decision letter never named one of the claims you filed, that claim was never decided at all. Not denied. Never answered. Which means it may still be pending today, with your original filing date still attached to it. For decades the VA could stay silent on a claim and later argue that its silence had been a denial. Your appeal window opened the day that letter landed and quietly closed a year later, and nobody ever told you a decision had been made. In Hamill v. Collins the Federal Circuit ruled unanimously that this is no longer allowed under the Appeals Modernization Act, writing that no veteran can appeal a decision he does not understand to have been made. First, what the law now requires the VA to put in that letter: the issues it adjudicated, the evidence it considered, the findings favorable to you, and which elements you did not satisfy. Compare that list against everything you originally claimed and circle anything missing. Second, the claim this hits hardest: Total Disability based on Individual Unemployability, which pays at the full 100 percent rate even when your combined rating is far lower, and which is usually raised by the evidence in your file rather than by a form you filled out, making it the claim VA overlooked more than any other. Third, the part that carries the money: if a claim was never adjudicated it never stopped being pending, so the effective date may still be the day you originally filed. Ninety months at the 100 percent rate, back to February 2019, adds up to $311,387. One honest limit, stated up front: this ruling applies to VA decisions issued on or after February 19, 2019.
