π΄ Worried About a VA Rating Reduction? These 5 Rules Have Your Back
Veterans got a scare this year β the VA floated changes to disability ratings: more reexaminations, a new way of scoring conditions that medication controls. It felt like your check was suddenly on the table. Veterans, advocates, and lawmakers pushed back so hard the VA pulled it. And here's what most veterans still don't know: the law already protects your rating, and it gets stronger every year you hold it. This is the plain-English breakdown of the 5 protected-rating rules, the honest 4 ways the VA still can reduce you, and the due process you're owed if a reduction is ever proposed. We follow one veteran, Walt, and watch the protections lock in. THE 5 PROTECTED-RATING RULES 1) THE 5-YEAR RULE (38 CFR 3.344) β a rating held ~5 years is "stabilized"; the VA must prove SUSTAINED improvement, not one good exam. 2) THE 10-YEAR RULE (38 CFR 3.957) β after 10 years your service connection can't be SEVERED; the bottom can't fall out. 3) THE 20-YEAR RULE (38 CFR 3.951) β after 20 continuous years, your rating can't drop below its lowest level. Only exception: fraud. Near bulletproof. 4) THE 55-YEAR-OLD RULE β at 55 the VA generally stops routine reexaminations; no exam, no reduction. 5) 100% PERMANENT & TOTAL β "permanent" means no future exams are scheduled β one of the most secure spots in the system. THE 4 WAYS THEY STILL CAN (all in your control) Fraud Β· Clear and Unmistakable Error (CUE) Β· genuine sustained improvement Β· and the #1 self-inflicted reduction β missing a required C&P reexam. If you get a real exam notice, GO. IF A REDUCTION IS EVER PROPOSED The VA can't reduce you in secret. They must send a written proposal; you get 60 days to submit evidence and 30 days to request a hearing. Veterans win at this stage all the time β respond, send evidence, get a VSO.
