The Islamic scholar and thinker, Ayatollah Sayyid Kamal al-Haydari, said: "Lesson Title: Research on Human Purity (46) - Yesterday we said there is one obstacle to this argument, which is the phrase 'when you give them their due compensation' (4:24). Based on the context of verse 24 of Surah An-Nisa, the intended meaning of 'marriage' or 'chaste women' refers to temporary marriage, as Allah says, 'So whoever you have enjoyed [a temporary marriage] with, then give them their due compensation as an obligation.' It is argued that the word 'compensation' is not explicitly mentioned here, and therefore it refers to temporary marriage, specifically 'mut'ah' (temporary marriage). This discussion pertains to the Quran, not to hadith. There are two pieces of evidence to the contrary." These are the Quranic points of discussion. The first indication is within this same verse itself. The second indication is external, meaning from other Quranic verses. When I say external, I mean from other verses, because our discussion is Quranic, not narrative. The internal indication is that the blessed verse says, "And [lawful to you in marriage are] chaste women from among the believers and chaste women from among those who were given the Scripture before you, if you have given them their due dowry." This is a condition: "if you have given them their due dowry." Just as it includes chaste women from among those who were given the Scripture before you, it also includes chaste women from among the believers. No one has said that this verse indicates the permissibility of temporary marriage with chaste women from among the believers. Therefore, if we consider the verse and the condition, then it refers to both of the aforementioned matters: chaste women from among the believers and chaste women from among those who were given the Scripture before you. Thus, all those who have examined this verse have said that this condition refers to both of them together, not to one of them specifically. No one has said that "chaste women from among the believers" refers to temporary marriage. The second indication is external, meaning from other Quranic verses. When I say external, I mean from other verses, because our discussion is Quranic, not narrative. Therefore, the author of Al-Jawahir in volume 30, page 39, says that the claim that the verse appears in the context of temporary marriage, based on the evidence of wages, considering the mention of wages in it, which appears in its compensation, meaning in the compensation for temporary marriage, unlike permanent marriage. In permanent marriage, the wage is not expressed, but rather the dowry is expressed, the dowry is expressed, the dowry is expressed, the dowry is expressed, the dowry is expressed, the dowry is expressed, you have given them the dowries of the gift, and this is the difference between the dowry with a fatha and the dowry with a damma, for its compensation is called the dowry and the dowry and the like. This claim is refuted, even though there is no evidence to prevent the word wage from being restricted to that, until another clarifies that basically the verse, there is no problem or doubt that the verse has included chaste women from among the believers and chaste women from among the People of the Book, and there is no doubt that the believing women are not restricted to temporary marriage, but it includes temporary and permanent marriage. This is the internal evidence in the verse. Someone might say no, basically this condition, if you give them their wages, this condition refers to the chaste women from among those who were given the Book only, this condition does not refer to what came before it, why? Because if two things are mentioned, and then a condition is mentioned after them, does it refer to both things together, or to the one that comes later? The answer is: It cannot refer to both. Why? Because when the verse says, "If you give them their due compensation," it mentions three other conditions that are definitively and certainly encompass both: that they be chaste, not committing adultery, and not taking lovers. This applies to all of them. This isn't limited to this condition alone, but includes the first two. This is what pertains to the internal evidence. As for the external evidence, let's look at the Holy Quran. In the Holy Quran, there is a passage, "If you enjoy them with their due compensation," where the word "enjoyment" and "temporary marriage" are mentioned. Does this indicate that the compensation is exclusive to them, or not? The answer is no. What evidence supports this? The following evidence supports it: The first piece of evidence: Verse 25 of Surah An-Nisa' says, "Then marry them with the permission of their guardians and give them their due compensation in a fair manner." After this, is this temporary marriage or a marriage? And does "marriage" refer to a permanent marriage or a temporary marriage? It is either permanent or something b...
