Are you looking to work in the United States and have an employer willing to sponsor you? There is a visa category that helps people without advanced degrees or exceptional skills obtain a visa to work in the United States. Hi everyone! I'm Maria Cerrillo, an immigration law assistant at Brooks Law, and in this video, I'll be talking about the EB-3 green card category. The EB-3 green card category allows people with work experience in certain trades to obtain a job in the United States. To qualify for this green card, the applicant must receive a full-time job offer, and their employer must be willing to sponsor the entire immigration process. The process for obtaining an EB-3 green card consists of three phases: (1) labor certification; (2) the visa petition; and (3) the application for permanent residence. To begin the process... First, the employer must obtain a labor certification from the U.S. Department of Labor. To obtain this certification, the employer must prove that there are no U.S. citizens or green card holders eligible for or interested in the job offer and that the employer has the financial capacity to guarantee the foreign worker the corresponding salary for that job. The second phase: The Visa Petition: EB-3 The purpose of the visa petition is to demonstrate to USCIS that: First, the offered job has been certified by the Department of Labor; second, the foreign worker meets all the requirements listed in the labor certification; and finally, the sponsoring employer has sufficient resources to pay the offered salary. Note that the application process differs depending on the foreign employee's location: An applicant from outside the United States must complete and submit Form I-140, which is an Immigrant Petition for Alien Worker. Once this request is approved, the foreign employee can proceed with the immigrant visa application at the U.S. embassy in their country of residence. Alternatively, if the employee is already in the United States working legally with another type of visa, such as an H1, they may apply for adjustment of status. The third phase is the Legal Application for Permanent Residence. Assuming the foreign worker is in the United States on a temporary nonimmigrant visa, the foreigner and their family may be eligible to apply for adjustment of status at the USCIS regional service center. Keep in mind that U.S. Citizenship and Immigration Services (USCIS) can take several months to approve an application for adjustment of status. If the foreign worker is not in the United States, or does not qualify for adjustment of status, then they must apply for an immigrant visa at the appropriate U.S. consulate in their country of origin or country of residence. So, if you're an employer considering obtaining a green card for a foreign employee and are unsure which category to choose, or if you're a foreign worker unsure of the path to permanent residency, consider the EB-3 visa, which may be one of your best options.
