Government Lecture Point #1: *The first constitution in the world was adopted in the United States. *One of the first constitutions adopted in Russia was the Orlik Constitution. Before the current constitution, the following existed: 1. The USSR Constitution of 1924 ("Leninist") 2. The USSR Constitution of 1936 ("Stalinist") 3. The USSR Constitution of 1977 ("Brezhnevist") *The current Constitution of the Russian Federation It was adopted on December 12, 1993. Structure of the Constitution: 1) Preamble (what legitimizes the constitution) 2) Section I, which contains human rights and the structure of government 3) Section II, the final and transitional provisions (how the constitution comes into force) The constitution is the institution that legitimizes people as legal entities. Lecture Point #2 There are different types of human rights: 1) Personal rights (what is guaranteed to everyone), such as the right to life, physical integrity, freedom of movement, etc. 2) Historical rights - these include political rights, the right of people to participate in government (for example, participation in elections) 3) Economic rights - these include rights such as the right to property and entrepreneurial activity. 4) Social rights – this is a person's right to state assistance (if they need it) 5) Guarantees – how to ensure that all these rights are respected. For example: the right to a trial, i.e., all the above-mentioned rights will be protected in this trial. Lecture Point #3 Chapter 3 is devoted to the Federal Structure of the Russian Federation. According to the Constitution, Russia is a federal state. There are three lists of powers: 1. Exclusive powers of the federation 2. Joint powers, which fall under the purview of both the federation and a constituent entity of the federation (e.g., administrative law) 3. Exclusive powers of a constituent entity (which are not included in the above-mentioned powers) Chapter 4 is dedicated to the president Powers of the President of the Russian Federation: 1. The president is the Supreme Commander-in-Chief 2. Laws (the president participates in the promulgation of laws) 3. Government (the president has the authority to manage the government) 4. International policy (the president directs international policy) 5. Pardons (the president may grant pardons) Chapter 5 is dedicated to the Federal Assembly. The Federal Assembly consists of the State Duma and the Federation Council Chapter 6 is dedicated to the Government, which consists of the Prime Minister and a minister. The Government is the executive body for governing the state. Chapter 7 is dedicated to the Court. There are two courts in the Russian Federation: the Constitutional Court and the Supreme Court.
