Witness evidence and relief from sanctions: PJSC Tatneft v Bogolyubov [2020] EWHC 3250 (Comm)
In this Weekly Law Review, I look at the judgment in PJSC Tatneft v Bogolyubov and others [2020] EWHC 3250 (Comm). The case concerned the claimant's application for relief from sanctions. Part way through the trial, the claimant wished to call a further witness to give oral evidence. The court applied Denton v T H White Ltd [2014] EWCA Civ 906. This case is another which highlights how important it is to thoroughly consider what evidence is required at the earliest possible opportunity, and well before trial.
