Handling Cases Through Restorative Justice Mechanisms: Obstacles & Problems. The paradigm shift from a repressive criminal justice system to a more humane, participatory, and restorative-oriented criminal justice system is manifested in the mainstreaming of restorative justice. With it, substantive justice is expected to emerge within a fast, simple, and cost-effective judicial framework. The Restorative Justice Mechanism (MRM) is defined in Law Number 20 of 2025 concerning the Criminal Procedure Code. Its presence has become an integral part of the criminal justice system and has provided a legal basis for efforts to resolve cases through a dialogical approach and provide restitution for victims. As something new, the implementation of the MRM in practice still faces obstacles. Although the substance of the law has found its footing, understanding the legal structure paves the way for the emergence of a new legal culture, reinstating the concept that criminal justice is the ultimum remedium. On the other hand, overcrowding in correctional institutions due to overcriminalization in the use of criminal law mechanisms can be reduced through the MKR mechanism.
