In this video, you will understand what a void act is, what a voidable act is, the difference between absolute nullity and voidability, when a judge can declare nullity ex officio, and in what situations it is necessary for the aggrieved party to request annulment. What does it mean to say that an act is null and void? When is a contract considered nonexistent in the legal world? Nullity occurs when there is a violation of a rule of public order or the absence of an essential requirement foreseen in the Civil Code. Is a contract with an illicit object valid? Does a marriage prohibited by law produce effects? Can a will that does not observe essential formalities be valid? These are classic examples of absolute nullity, in which the act is born without legal validity and is not validated over time. A voidable act is different. It exists, produces effects, and is considered valid until someone requests its annulment. What is a defect of consent? What happens when there is error, fraud, coercion, or a state of danger? Can a contract signed under threat be annulled? What is the time limit for annulling a legal transaction? In the case of annulability, there is a statute of limitations, and if it is not observed, the act becomes valid. What is the practical difference between nullity and annulability? Can a null act be recognized at any time? Can a judge declare nullity even without a request from the party? Can an annulable act be confirmed? What is the validation of a legal transaction? When a party ratifies the act, the defect is remedied and the contract becomes fully valid. This occurs, for example, when a relatively incapable person enters into a contract without assistance and, upon reaching the age of majority, confirms the transaction.
