24X7 #438 / Estas son las probabilidades que tiene usted de juzgar a Begoña, la esposa de Sánchez
For the first time in history, the wife of the Prime Minister will be tried in court. The dishonor has fallen on Begoña Gómez. To add to the drama, Sánchez's wife will have to face a jury trial. Beyond all the short-, medium-, and long-term political consequences, both for the leader of the PSOE and for Spanish democracy, a crucial question arises: how will the jury that will judge Begoña be chosen? Despite the narrative of the left-wing media, the Madrid Provincial Court has upheld—with some reservations at certain points, as in any legal process—the ruling by Judge Juan Carlos Peinado and his decision that the case be tried by a jury. This decision means that nine Spaniards will have to judge the Prime Minister's wife. However, to be among those selected, a series of requirements must be met, although they are not particularly demanding. One must be a Spanish citizen and over 18 years of age. One must also be literate. The first screening process involves being registered as a resident in the province where the alleged crime was committed; in this case, Madrid. From the entire provincial census, every two years the authorities hold a lottery to create a "pre-selection" of citizens who can serve on a jury in any legal case. Currently, there are 2,846 names on the list. From this group, a second lottery is held, from which 36 people are chosen. Finally, after a process that checks for conflicts of interest and eligibility requirements, nine jurors and two alternates are definitively selected. What happens if a person is selected and doesn't show up? Being selected as a juror carries responsibilities, and failure to appear can result in fines of up to €1,500. However, even after being selected, there are circumstances that can disqualify a person from serving on a jury. Among the disqualifying factors are belonging to the royal family, the government, the State Security Forces, or the judiciary. Other disqualifying factors include being over 65 years old, having been convicted of an intentional crime, or residing abroad. Another factor that can be cited to exclude a person is having a direct or indirect interest in the case being tried. Given the high-profile and political nature of this case, in an environment so polarized precisely by Begoña's husband, this circumstance could be particularly relevant. Ideally, no juror should have shown any interest in the case during the last two years—the duration of the investigation—something unlikely due to the enormous media attention surrounding the matter. Therefore, they will have to conduct some kind of assessment of how much they know about the case, where they have obtained their information, and whether they have formed an opinion. It is worth noting that the judge, the prosecution, and the parties involved can all challenge a person's eligibility to serve on the jury. After understanding the process and given Madrid's population, the odds of someone being selected as one of the nine jurors are minuscule (0.00012651313), almost like winning the lottery.
