Neglecting a Hazard
The plaintiff says that on a rainy and stormy night, a tree fell on his car, pinning him against the seat. He was badly injured and nearly killed. He claims that a tree expert told him the tree should have been removed 30 years ago because it was a hazard. He is suing the owners of the tree, the defendant, for his losses. The defendants say they were outside warning drivers to avoid the fallen tree when the plaintiff, not paying attention, ran into it. They argue that the tree was rotted on the inside, something impossible to detect from the outside, and that the tree in question belongs to the town.
