When Ilse Barchnitzki awoke from her medically induced coma after serious heart surgery, her world had changed. Although the 86-year-old gradually fought her way back to her old life, someone else was now making decisions for her. During her coma, a legal guardian was appointed because the authorities were unable to locate any relatives. This guardianship had far-reaching consequences, because from then on, Ilse Barchnitzki had to fear for everything that was important to her: her apartment, her car, her right to live independently. Even long after she had regained consciousness, it was clear there was no going back: others now controlled her life. Suddenly, she was to be permanently placed in a nursing home. All she wanted was to go home. Ilse Barchnitzki couldn't defend herself, however, because there were doubts about her legal capacity. Only when attentive neighbors intervened did the situation seem to change. Many people find themselves in Ilse Barchnitzki's situation. In Germany, over 1.3 million people are under legal guardianship. This can be due to a mental illness, a mental or physical disability, or dementia. And very few people know what it means to be under legal guardianship. The legal guardian manages financial affairs, oversees assets, and makes decisions regarding healthcare. These decisions are meant to be in the best interests of the person under guardianship—yet serious conflicts repeatedly arise, causing suffering for both the person under guardianship and their guardian. There are also instances where guardians abuse their power and even commit criminal acts against those they represent. In January 2023, a new guardianship law, the result of much debate, came into effect. Its aim was to strengthen the interests of those under guardianship, particularly by giving greater weight to their wishes and closing loopholes for criminal activity. Critics, however, argue that the law primarily involves cosmetic changes and will not fundamentally improve the situation for those under guardianship in key areas. One problem, in particular, runs like a common thread through the entire issue.
