Ramaphosa Stopped His Impeachment Hearings 2 To 1
On 24 July 2026 the Western Cape High Court granted President Ramaphosa an interim interdict halting Parliament's impeachment hearings over Phala Phala. The bench split 2 to 1. Most of the coverage named all 3 judges and stopped there. The judge who wanted the impeachment to carry on was Judge Francis, sitting alone, and he was outvoted by the most senior judge in the room. His is the one labelled the first judgment inside the document, which is part of why the split got reported the way it did. I read all 125 paragraphs. Most of what is in there has not been reported, including a passage at paragraph 60 where Francis takes apart the Constitutional Court authority the majority leaned on to grant this interdict. I have no legal training. I am an ordinary person who sat down and read a judgment, so if there are legal minds watching who think I have this wrong, say so in the comments. What this video covers: Which judge wrote which judgment, and who actually formed the majority Rule 129G and the fight over sufficient evidence against a prima facie case Why Judge Davis never decided whether the President is right about the rule The Eskom judgment the majority relied on, and what paragraph 60 says about it Rule of law harm, the doctrine Davis named for herself Francis on why that reasoning proves too much What the President's replying affidavit says about a further stay pending appeals Why this may not be the short delay it is being called The review is set down for 2 to 4 September 2026 under case number 2026-119192.
