The judge doesn't decide alone — in more than 80% of cases, they follow the report of the court-appointed expert. Therefore, all the evidence needs to be gathered before the expert report. The three questions that define the causal link: what is your illness, what was there at work that may have caused or worsened it, and how to prove that this situation existed. The law recognizes both direct causality and contributing cause — when the work aggravated or triggered a pre-existing condition (Article 21, I of Law 8.213/91). The documents that carry the most weight are: the PPP (Occupational Health and Safety Profile), which the company is required to issue; the report from CEREST (Worker's Health Reference Center), a free public service; and the CAT (Work Accident Report), with different weights depending on who issues it — company, CEREST, doctor, or self-declared.
