Hey folks In a trail initiated on a police report the Magistrate has the entire evidence to decide whether a charge is ground less. So that he can discharge the accused. But a trail initiated other than on a police report there would be no presence of such evidences. So, the Magistrate at the very instance of the case record evidence of prosecution.
