Therefore, we must say that children don't always perceive reality correctly, and this can give rise to gross misunderstandings, if not false accusations. This isn't because the child knows he's lying, but because the minor lies without knowing he's lying. In other words, the child may misunderstand reality due to his mental limitations or because he's been influenced, influenced, or influenced by his age. Let's think about a child who misunderstands reality because he can't properly decode it or because he's been influenced. Example: Dad pinches Mom. That gesture could be a playful one, but the child, perhaps influenced later by the mother, could revisit that scene and interpret it as abuse or violence. Well, how can one, from a defense perspective, prove that those accusations are false? It will be necessary to demonstrate in court that the minor's account is unreliable. The unreliability, for example, could have been caused by conditioning by an adult. Let's take another example. Consider the case of a father who uses the bidet on his daughter. The mother, during the separation, might ask his daughter: "Did dad touch your French fries?" "Yes." "And when?" "When we were in the bathroom." "And did it hurt?" "Yes, a little." "Did it burn?" "Yes." The defense's efforts will demonstrate that the father in the bathroom was not satisfying an unhealthy sexual desire but was simply using the bidet on his daughter. Unfortunately, within family feuds, the process of monstrosity is the order of the day. At that point, a neutral gesture could take on a sexualizing tone because its meaning can be influenced by the person asking the question, who, through gestures, tone, comments, and leading questions, could convey to the child the idea that the father has committed a terrible act. But how does one defend oneself against all this? The defense attorney must, through cross-examination of the prosecution's witnesses and the child himself, demonstrate that the child was influenced. The classic case is when a couple separates and—coincidentally—during a contentious separation, these abuse incidents erupt. In these cases, the Public Prosecutor, the Civil Party, and the Judge obviously have an emotional predisposition to believe that a child is telling the truth and has been abused. After all, most people ask, why would a child lie? The reality, however, is not what it seems. We can represent this aspect through Plato's myth of the cave. Plato tells us to imagine people who have been chained since birth. They see reality projected onto a wall. Specifically, they think they see horses and warriors, but, as can be seen from the image, they are actually shadows reflected on the wall. It's just a theatrical representation; it's not reality. Even the Judge can sometimes fall into this grave error, and it's the defense's job to help him find the truth. So how do we break the chains and bring those who are chained—in this case, the Judge—to the light of reality? Well, for example, by showing him a piece of reality he doesn't know. Returning to the previous example, it will be necessary to demonstrate in court the ongoing conflict between the spouses by bringing to the Judge's attention what is at stake (higher maintenance, assignment of the family home, sole custody of the minor, the cancellation of one spouse in favor of the other, or simply revenge to be exacted). So, once the ongoing intrafamily conflict has been proven, it will be necessary to make the Judge understand that the disclosure of the abusive behavior was influenced by the spouse who was involved in that conflict, through suggestive means.
