These questions are fundamental because a common-law marriage is a legitimate form of family formation, as provided for in both the Constitution and the Civil Code. But what about rights and responsibilities when this relationship ends? The division of assets in a common-law marriage generally follows the partial community property regime, meaning that all assets acquired during the marriage belong to both partners, even if they are in the name of only one of them. But are assets received through inheritance or donation included in the division of assets? And what happens to properties purchased before the union began? Another important point is the issue of debts. Are all debts shared? The answer is no: only those incurred for the benefit of the family, such as mortgages on a home or children's education expenses.
