SENADOR DETONA DECISÕES DO SUPREMO (STF): “EXCRESCÊNCIA, ESTAPAFÚRDIAS E BARBÁRIE JURÍDICA”

Senator Esperidião Amin (PP-SC) harshly criticized the Supreme Federal Court (STF) during a speech in the Senate plenary on Tuesday (30). The parliamentarian again attacked Inquiry No. 4,781, known as the fake news inquiry, classifying the procedure as a "legal excrescence" and a "true inquisition" maintained by the Court. According to Amin, the inquiry opened in 2019 represents an "attack against the rule of law" and has been in effect for "7 years and more than 3 months". The senator stated that he has condemned the procedure since its creation and said that the case symbolizes a "legal barbarity". "I have condemned here Inquiry 4781, also called the fake news inquiry. This is a legal excrescence and a true inquisition that the Supreme Federal Court has been sustaining," he declared. Senator Amin also criticized the inquiry related to the events of January 8, 2023, stating that the investigations and convictions follow a "narrative not based on facts." According to the senator, there are "absurd" decisions and "exorbitant" sentences imposed on defendants accused of participating in the attacks on the headquarters of the Three Powers. The parliamentarian especially questioned accusations such as violent abolition of the Democratic Rule of Law, coup d'état, aggravated damage, deterioration of listed heritage, and armed criminal association. According to Amin, there is insufficient material basis to support some of these charges. "Without a single weapon having been recovered from this armed revolt to which the inquiry alludes," the senator stated. During his speech, Amin also mentioned the progress of proposals related to those convicted on January 8. He cited the bill on sentencing guidelines, approved by Congress, vetoed by the President of the Republic, and subsequently with the veto overturned by parliamentarians. The senator also mentioned that he had presented an amnesty bill, which is still being processed in the Senate. Amin demanded a ruling from the Supreme Federal Court (STF) on the validity of the law approved by Congress after the presidential veto was overturned. “The Supreme Federal Court has not yet ruled on the validity of the law that we approved and the overturning of the veto that we, by a large majority, decreed,” he said. In his speech, the senator stated that Brazilian judicial decisions related to January 8th are beginning to generate negative international repercussions. For him, the problem has ceased to be merely an internal disagreement between branches of government and has begun to affect Brazil's image abroad. “It is not just a problem for Congress, it is not just a problem for the Judiciary, it is not just a problem for the Executive, it is a problem for Brazil,” he declared. Amin concluded his speech by stating that the country is normalizing what he called a “legal extravagance.” The senator said he would leave the full text of his statement recorded in the Senate's stenographic register and promised to return to the topic. "We cannot accept the trivialization of legal extravagance that is thriving in Brazil," he concluded.
