PARTY WALL ACT EXPLAINED | When and how to Serve a Party Wall Notice | BlackBeltBarrister

Many of you have asked for the Party Wall Act to be explained and broken down into simple terms. If you plan to build on or have work done to your property on the boundary of your property, you may need to serve a Party Wall Act Notice under the 1996 Act. A Party Wall Notice will give your neighbour time to consider the works and whether anything else needs to be done, or whether they object. If there is an agreement this will be a "Party Wall Agreement" and works can continue. If not, a surveyor or surveyors will be appointed to agree an "Award" - i.e. a resolution as to how the works should be done. The Party Wall Act is not designed to prevent work from being carried out but to give fair notice, the opportunity to object, and to have a say in "how and when" the works are carried out.
