💍 Best Immigration Option When Petitioning for Your Significant Other

Are you a U.S. citizen looking to bring your fiancé(e) or spouse to the United States? Choosing the right petition is critical — and the path you choose can make the difference between years of waiting abroad or your loved one entering the U.S. as a permanent resident. Here are the main options explained: ✅ Fiancé(e) Visa (K-1): Only U.S. citizens can petition for a fiancé(e). This is a multi-step process: First, the fiancé(e) visa is approved through consular processing (which can take up to 2 years). Upon entry to the U.S., you must get married. After marriage, your spouse must apply for Adjustment of Status (AOS) to receive their green card. ✅ Spousal Petition (Consular Processing): If you’re already married, you can file an I-130. Once approved, your case is transferred to the National Visa Center (NVC), which typically takes about 6 weeks for transfer and another 3 months for processing before going to the U.S. consulate abroad. Processing times vary by country, but once your spouse enters the U.S., they arrive as a permanent resident with a green card in hand. ✅ Spousal Petition (Adjustment of Status from Inside the U.S.): If your spouse entered lawfully with a non-immigrant visa and later decided to stay, they may qualify for Adjustment of Status from inside the U.S. This option is often much faster, but once you file, your spouse cannot leave the country until travel authorization is granted — otherwise they risk abandoning the application. ⚖️ Each path has benefits and drawbacks.
