Here's the reality: An estimated 40% of VA decision letters fail to explicitly address every issue the veteran raised. Forty percent. Nearly HALF of all decision letters leave something out or use language so vague that veterans don't even know a decision was made. In 2026, the Federal Circuit handed down Hamill v. Collins — and it changes EVERYTHING about how the VA has to communicate decisions. The court's reasoning was simple and powerful: "No veteran can appeal a decision that he does not understand to have been made." If the VA didn't EXPLICITLY address something you claimed — TDIU, a secondary condition, unemployability, anything — that decision may NOT be final. And if it's not final? Your original effective date is PRESERVED. We're talking potential YEARS of back pay. ABOUT DR. While I am a licensed physician, former C&P examiner, and disabled veteran, I am not YOUR attorney unless we have established services. Hamill v. Collins is a 2026 Federal Circuit decision. The interpretation and application of this ruling is still evolving. Individual case outcomes will depend on the specific facts and circumstances of each veteran's claim. Finding a potential Hamill issue does not guarantee that back pay will be recovered or that the underlying claim will be granted. Veterans must still prove entitlement to the benefits claimed. If you believe you have a Hamill issue involving significant potential back pay, consult with a VA-accredited attorney before taking action. Complex legal claims benefit from professional representation. The Appeals Modernization Act (AMA) applies to decisions made on or after February 19, 2019. Claims decided under the legacy system prior to that date may be subject to different rules. For guidance on your specific situation, consult with a VA-accredited claims agent, attorney, or Veterans Service Organization (VSO). #HamillVCollins #VADisability #ImplicitDenial #VABackPay #VAClaims #AppealsModernizationAct #AMA #VADecisionLetter #EffectiveDate #TDIU #SecondaryServiceConnection #VeteranBenefits #VAClaimsHelp #FormerCPExaminer #ArmyRanger #CombatMedic #XterraHealth #VeteranAdvocate #VAAppeals #ClaimsAudit #VARating #DisabilityBenefits #VeteranRights #FederalCircuit #VALaw #ClaimsEvidence #VeteranAttorney
