Enforcement of penalties in other EU countries for serious traffic offenses has been possible since the 4th EU Driving Licence Directive. The central information system RESPA plays a crucial role in this, as all this information is recorded there. Its purpose is, for example, to prevent someone from obtaining a new driving licence while a driving ban is still in effect in another country. This will work, and it will be enforced, but that doesn't mean that legally circumventing the MPU (Medical-Psychological Assessment) will be impossible in the future, for the following reason: The MPU requirement is a purely national matter, recorded in the driver fitness register in Flensburg. This register only exists in Germany. Before a new license is issued, the RESPA (Reference System for Driving Licenses) is checked, but the MPU requirement is not recorded there. This means that, in principle, when an EU driving license is reissued, the mutual recognition obligation applies, and driving is permitted again throughout the EU, including in Germany, even if the MPU requirement still exists in Germany. This is the reality; the European Court of Justice has ruled on this. If one EU member state determines driving fitness positively, another member state, namely Germany, cannot say: "In our case, driving fitness still needs to be clarified from an MPU perspective." The mutual recognition obligation still applies, even under the new 4th EU Driving Licence Directive. This means that, in principle, when an EU driving license is reissued, the mutual recognition obligation applies.
