Sources of Law in Ghana The sources of law in Ghana are the fundamental foundations from which legal authority is derived. These include: 1. The Constitution: As the supreme law of the land, it sets out the structure of government and guarantees the rights of citizens. All other laws must align with its provisions. 2. Acts of Parliament: These are laws enacted by the legislative body of Ghana and have binding authority across the country. 3. Subsidiary Legislation: This refers to laws made by an authority under powers granted by an Act of Parliament, typically in the form of regulations or rules to support the implementation of primary legislation. 4. Existing Laws: These are laws that were in effect before the current Constitution came into force. They remain valid unless they conflict with the Constitution. 5. The Common Law of Ghana: This is the body of law developed through judicial decisions and includes principles of English law as applicable in Ghana, provided they do not conflict with local statutes. Each of these sources contributes to the legal framework that governs Ghana and ensures the country’s legal system operates effectively.
