The Defense argued for dismissal, but it was swiftly denied, as these motions are rarely granted during a trial. Defense Attorney, Robert Alessi, argued about a stronger jury instruction regarding the holes in John O'Keefe's hoodie. The defense is requesting a curative instruction stating that Mr. Wolfe was correct in saying that the holes were made by the Massachusetts State Police Crime Lab during inspection, not from an alleged fall and that the implication made by Special Prosecutor, Hank Brennan, was knowingly incorrect. Prosecutor, Adam Lally, argued the initial instruction was sufficient. The court discussed the instruction on reaching a verdict for each individual indictment, confirming it was upheld by the Supreme Judicial Court. The defense proposed a different verdict form than the standard one used in the last trial, arguing the previous one was confusing. The court may not grant this change. The Commonwealth is not asking for lesser included charges, but the defense is. The court can still give them, which is not true in all jurisdictions. Lesser included charges are less serious crimes that are part of the primary charge (e.g., plain DUI or involuntary manslaughter for vehicular manslaughter with DUI). The defense is asking for them to give the jury "room to compromise." The court granted an hour and 15 mins for Closing Arguments. The Judge wants jurors in seats by 8:45 AM for closing arguments to start promptly at 9:00 AM. After arguments, there will be an early lunch, then the final jury charging (about an hour). The court wants the jury to start deliberating tomorrow and is asking if they are willing to stay until 5:00 or 5:30 PM to allow for deliberation time before the weekend.
