EMPLOYEES WITH DISABILITIES: What Your Employer Isn't Telling You In France, the law protects people with disabilities, particularly in the workplace. Employers have obligations: they must employ a certain proportion of employees with disabilities, and if they don't meet the legal requirements, they must contribute to AGEFIPH (the French association for the management of funds for the professional integration of disabled people). They can also contact ESATs (sheltered workshops) or Adapted Enterprises to promote the employment of people with disabilities. Another important obligation is the requirement to adapt the workstation and working conditions of an employee with a disability, especially if they are declared disabled during their career. It is possible to hide one's disability from one's employer, but being recognized as a disabled worker brings advantages: adjustments to the job, working conditions, schedule, additional days off, etc. Employee representatives, elected members of the Works Council (CSE), and union delegates have an important role to play: they must support employees facing this type of situation, and they must also be consulted by the employer before any major decision concerning a disabled employee, a reassignment, and especially a dismissal. The occupational physician also has a crucial role to play in supporting these employees. It is essential not to hesitate to consult them without waiting for the legal deadlines. This video aims to provide employees with more precise information about their rights in this area, so they can benefit from the full protection of the law and all the provisions that can improve the lives of these disabled employees.
