Conscientious Objection and the Duties of the Objector In this session, Professor Leandro Cornejo addresses conscientious objection and the duties of the objector within the framework of the constitutional protection of sexual and reproductive rights. First, he distinguishes this right from civil disobedience, noting that the latter seeks to transform the political or legal order, while conscientious objection aims to preserve the moral integrity of the individual in the face of a legal duty incompatible with their deepest convictions. He also analyzes the legal and jurisprudential treatment of this right, highlighting its exceptional nature and the requirement of conclusive proof of the convictions invoked. Finally, he defines its holder, specifying that it belongs exclusively to natural persons, and details the ethical and legal duties assumed by objectors in the healthcare field, including promptly informing healthcare providers of their conscientious objection, providing information on available alternatives, making appropriate patient referrals, and acting immediately in medical emergencies.
