Send an email to [email protected]. 📄 The action for review of a foreign judgment is a special procedure provided for in Article 978 of the Portuguese Code of Civil Procedure, which stipulates that no decision on private rights issued by a foreign court is effective in Portugal, regardless of the nationality of the parties, without being reviewed and confirmed. Thus, while a Portuguese citizen married in Brazil must register their marriage in Portugal without needing to file a lawsuit, the same cannot be said of a divorce: it is necessary to review the foreign decision so that the act is recorded in the birth certificate. The same applies if the divorce was carried out through a public deed in Brazilian Civil Registry Offices. Although typically an appeals court, the Regional Court is the one that processes the action in the first instance (Article 73, paragraph e, of Law No. 62/2013), with jurisdiction belonging to the area of ​​domicile of the person against whom the judgment is to be enforced. If that person resides abroad, the Court of Appeal of Lisbon will have jurisdiction. The requirements for review are listed in Article 980, and the value of the case is governed by the provisions of Article 303, § 1, of the CPC.
