इलाहाबाद हाईकोर्ट ने मुस्लिम लड़कियों की शादी को लेकर अहम टिप्‍पणी की है। एक मामले की सुनाई के दौरान न्‍यायमूर्ति जेजे मुनीर और न्‍यायमूर्ति अचल सचदेव की खंडपीठ ने कहा कि शरिया या मुस्लिम पर्सनल लॉ से ऊपर पॉक्‍सो और बाल विवाह निषेध कानून है। शरिया या पर्सनल लॉ इसका उल्‍लंघन नहीं कर सकता। देश के प्रत्‍येक नागरिक के लिए शादी की न्‍यूनतम आयु समान है। शरिया कानून किसी लड़की की शादी के लिए किशोरावस्‍था को उपयुक्‍त मानता है पर यह बाल विवाह निषेध अधिनियम 2006 और पॉक्‍सो एक्‍ट का स्‍पष्‍ट उल्‍लंघन करता है। The Allahabad High Court has made an important observation regarding the marriage of Muslim girls. During the hearing of a case, a division bench comprising Justice JJ Munir and Justice Achal Sachdeva stated that the POCSO Act and the Child Marriage Prohibition Act are superior to Sharia or Muslim Personal Law. Sharia or personal law cannot violate these laws. The minimum age for marriage is the same for every citizen of the country.
