L20: Public Employment, Unatouchability & Right to Freedom | Article 16, 17, 18 & 19 || CGPSC
Welcome to Lecture 20 of our Indian Polity series! In this session, we continue our deep dive into Part III of the Indian Constitution, exploring the critical protections provided under Articles 16, 17, 18, and the expansive Article 19. This lecture is designed to provide aspirants with both conceptual clarity and detailed notes for CGPSC, UPSC, and other competitive exams. We simplify complex topics like the Reservation Policy (Article 16), the absolute nature of Article 17, and the "Six Democratic Freedoms" guaranteed to every citizen under Article 19. 📌 Topics Covered in This Lecture: 1. Article 16 – Equality of Opportunity in Public Employment: • Understanding the 7 grounds of non-discrimination (Religion, Race, Caste, Sex, Descent, Place of Birth, Residence). • Exceptions: Residence-based requirements (Parliament's power) and Reservation for Backward Classes. • Article 16(4A): Special provisions for reservation in promotions (SC/ST). • The 10% EWS Reservation (103rd Amendment) explained. 2. Article 17 – Abolition of Untouchability: • Why Article 17 is "Absolute in Nature." • Its unique application against both the State and private individuals. • The Protection of Civil Rights Act and the "Purity & Pollution" concept. 3. Article 18 – Abolition of Titles: • Why the State cannot confer titles like "Rai Bahadur" or "Khan Bahadur." • Professional and Academic distinctions (Dr., Er., Col.) vs. Hereditary titles. • The legal standing of National Awards (Bharat Ratna, Padma Awards) as honors, not titles. 4. Article 19 – Protection of the Six Freedoms: • 19(1)(a): Freedom of Speech & Expression (Press, Internet, and the Right to Silence). • 19(1)(b): Right to Assemble peaceably without arms. • 19(1)(c): Freedom to form Associations, Unions, and Co-operative Societies. • 19(1)(d): Freedom of Movement (Inside India vs. Outside India under Article 21). • 19(1)(e): Freedom of Residence and Settlement. • 19(1)(g): Freedom to practice any Profession, Trade, or Business. 5. Reasonable Restrictions: • Understanding that rights are not absolute. • Grounds for restriction: Sovereignty and Integrity of India, Security of the State, Friendly Relations with Foreign States, Public Order, Decency, Morality, Contempt of Court, Defamation, or Incitement to an Offence. This session provides the clarity needed to master the most practical and legally significant rights in our democracy.
