Virginia, 448 U.S. 555, 573 (1980) (plurality opinion) Likewise, the First Circuit has held that under the First and Fourteenth Amendments, “the public and the press enjoy a constitutional right of access” to criminal proceedings, “most pretrial proceedings[,]” and “to documents and kindred materials submitted in connection with the prosecution and defense of criminal proceedings.”  In re Providence Journal Co., 293 F.3d 1, 9 (1st Cir. 2002).
