The case of the police officer killed in Völklingen is among the most highly charged criminal and public trials of the year. So far, the most established facts are those released by the Saarbrücken Regional Court in its press statement on the verdict of April 1, 2026. According to the official statement from the Regional Court, the defendant was accused of shooting several police officers with a firearm in Völklingen on August 21, 2025, following a robbery at a gas station. One officer involved in the operation died from his gunshot wounds, and another was injured. The public prosecutor's office had charged the defendant with murder, attempted murder, and aggravated robbery, basing its arguments, among other things, on intent to conceal a crime, cruelty, and lust for killing. The Federal Court of Justice has long required a multi-stage examination: First, a disorder must be established that falls under one of the statutory criteria. Then, the severity and impact of this disorder on the perpetrator's mental capacity must be examined. Finally, the decisive question is how the disorder affected the specific act at the time of the offense. It is particularly important to note that a diagnosis alone is not sufficient. The Federal Court of Justice explicitly emphasizes that even a diagnosis of paranoid schizophrenia, in itself, does not justify the assumption that criminal responsibility was absent or significantly diminished. What is required is a concrete and consistent explanation of how the diagnosed disorder affected the individual's capacity for insight and self-control in the specific circumstances of the case. Therefore, not only psychiatric labels are relevant, but also the actual behavior before, during, and after the act, the motive, the trigger, and the specific manner in which the act was carried out. According to Section 63 of the German Criminal Code (StGB), the court orders placement in a psychiatric hospital if someone has committed an unlawful act while legally insane (Section 20) or with diminished responsibility (Section 21), and the overall assessment of the offender and the act indicates that, due to their condition, they are likely to commit further serious unlawful acts and are therefore a danger to the public.
