Instead, hundreds of millions of rand were allegedly redistributed across personal accounts, associated entities, and luxury expenditures — while thousands of investors believed their money was being actively traded. As legal pressure mounted, Van Niekerk became involved in proceedings tied to liquidation and recovery efforts. On 31 August 2025, he received a threat warning him to withdraw from the matter. He did not. On 5 September 2025, he was shot and killed inside his law office in Saxonwold, Johannesburg. In a later development, Mukelani Ntombela appeared in the Johannesburg Magistrate’s Court, charged with Van Niekerk’s murder and possession of an unlicensed firearm. He was positively identified in an identity parade. According to court proceedings, he is one of four individuals allegedly involved in the coordinated attack — with others still at large. The case has been postponed as investigations continue. Meanwhile, over 2,200 investors are still owed an estimated R262 million in capital.
