Should I continue to pay the bills of the person that just died? Hi, I'm Darren Findling of The Probate Pro. Let's discuss what happens after somebody passes away and there are outstanding obligations… bills that exist. What we do know is that the creditors, these are the people that are owed money to, they don't stop. They don't pause. There's no obligation for them to put a hold or a pause as you and your family are mourning and grieving and addressing the affairs following the death of the individual. Businesses is as usual for them. If you fail to make a mortgage payment, the property can go into foreclosure. If you fail to pay a property tax, the property can go into tax forfeiture. If you fail to pay the IRS, the IRS's interests and penalties will continue to accrue. And so on, and so forth. Now we have to differentiate between those types of creditors that are really critical to make sure that you pay and those that you can take a pause and assess whether you need to pay them so for example if you're living in a house and somebody dies and they own the property and the water bill comes due and it's delinquent or the gas bill or the lights bill if you don't pay those bills the lights the water the gas could be turned off so yes we want you to maintain the property in a condition so that there's no waste we call that a reduction in the asset itself or a risk to your own enjoyment of the property we don't want you to have a house in which there are no lights so pay those bills same thing with a mortgage and property taxes but there are many bills that you can simply just wait for a moment take a deep breath and address through the probate Administration those bills include unsecured creditors or creditors that have no impact on the general enjoyment or the use of the properties that you're concerned about so immediately following death continuing to ensure that there's payment of those obligations that are going to cause you harm or injury if you don't do so we encourage you to do that other creditors like medical bills I General unsecured creditors or credit card bills those you can take a breath pause for a moment and then assess whether you need to pay those through the probate State Administration in Probate you address both the assets these are things that people own as well as the debts and there are times that if there's no need for probate or if the assets are not significant enough because there are exemption and allowances there may not be a need to pay those unsecured creditors it is in these circumstances that following the death of an individual we strongly urge you to consult with a skilled competent probate practitioner to guide you through these very time sensitive issues of course we're here to help at The Probate Pro you can call us at 1-833 PROBATE or visit us at theprobatepro.com.
