About (1) Retainer Fees and (2) Basic Fees There are three types of divorce: consensual divorce, mediated divorce, and judicial divorce. If the divorce is subsequently agreed upon through negotiation, you'll be charged a basic fee of 300,000 yen (plus consumption tax). If your case is not resolved through negotiation and proceeds to mediation, we will add an additional 100,000 yen to the above fees. If the case proceeds to court rather than mediation, we will add an additional 100,000 yen each. If a divorce is finalized without any financial transactions between the parties, the attorney's fees will be limited to the fees listed above. {③ Regarding Compensation for Economic Benefits} In the case of divorce, compensation for economic benefits primarily includes marital expenses, child support, and property division. In addition to the retainer fee and basic fee, if you obtain economic benefits from the other party or block (defend) a claim from the other party, we charge 10% of that benefit (plus consumption tax) as compensation for economic benefits. On the other hand, because marital expenses and child support are expenses closely related to living expenses, our fee is reduced to 7%. Furthermore, the calculation period for attorney's fees is a maximum of two years for marital expenses and a maximum of seven years for child support. Calculation using a specific example This calculation assumes a divorce is finalized through mediation for a family with a 7-year-old child, with the other party paying a total of ¥840,000 in marital expenses, ¥5 million in property division, and ¥50,000 per month in child support until the child turns 20. ① First, the fee the client is required to prepare at the time of contracting is a ¥400,000 retainer. Calculation: ¥300,000 retainer + ¥100,000 for mediation procedures = ¥400,000 ② The fee to be settled at the end of the case is the following fee of ¥1,252,800. (1) Basic fee of 300,000 yen + 100,000 yen = 400,000 yen (2) Compensation for economic benefits Property division: 500,000 yen (10% of 5 million yen) Marital expenses: 58,800 yen (7% of 840,000 yen) Child support: 294,000 yen (7% of 50,000 yen x 12 months x 7 years) The costs to be settled at the end of the case can be settled from the 840,000 yen in marital expenses paid by the other party and the 5 million yen received from property division.
