There is another document you cannot forget, which is the ACCOMMODATION AUTHORIZATION. Many people are being barred at hotel check-in precisely because they don't have this document. But did you know that there are some situations where you won't need this Accommodation Authorization? If you want to understand everything about this subject, this video is for you! Folks, according to article 82 of the Statute of Children and Adolescents (the famous ECA), it is prohibited to accommodate a child or adolescent in a hotel, motel, boarding house or similar establishment, unless authorized or accompanied by their parents or legal guardian. According to this law, commercial establishments that fail to comply with this legal requirement will be subject to administrative penalties, which can range from a simple fine to the revocation of the license and the permanent closure of the premises, all as stipulated in article 250 of the ECA (Brazilian Statute of Children and Adolescents). To better explain this ECA rule, when lodging involves a child or adolescent, both parents or the legal guardian (the one who has custody by court order) must be present. For the purposes of the law, it doesn't matter if you are an uncle, grandfather, or older sibling. If both parents are not present at check-in, a written lodging authorization with notarized signatures will be required. But then a question arises: What if only one parent is present? Is this lodging authorization still necessary? Parental authority is exercised under conditions of full equality between the father and mother; CONANDA (National Council for the Rights of Children and Adolescents) has changed its understanding and published Technical Note No. January 2011. Interpreting articles 21 and 82 of the ECA (Brazilian Statute of Children and Adolescents), it was highlighted that if the child is accompanied by one parent, there is no need for authorization from the absent parent. For establishments, there is no need to fear these administrative penalties if they follow the guidance of the CONANDA Technical Note. As I mentioned, this is an agency of the Executive Branch, the same branch responsible for its oversight. So, if you did everything correctly and an inspector still makes a fuss, this Technical Note allows you to have the citation annulled. For consumers, if you have all the necessary documents for accommodation, except for the authorization from the absent parent, and your accommodation is still denied, ask to speak with the manager and inform them about Technical Note 1 of 2011. If they still deny accommodation, somehow document what happened (police station, cell phone, email) and contact a trusted lawyer or the Public Defender's Office to seek fair compensation. Now, if the trip is without the parents or legal guardian, you will need this accommodation authorization. And look how easy it is. Folks, this is a very simple authorization to make. There are several templates on the internet, both on the websites of Public Institutions, such as State Courts, and on the websites of Private Institutions, such as hotels and travel agencies. In short, this accommodation authorization has three fundamental parts. The first part is the qualification of the interested parties, where you will fill in the data of the guardians, the child or adolescent, and the guardian who will accompany them (if applicable). The second part that you need to fill in correctly is the name and address of the establishment and the period of the minor's stay at that location. Finally, the third and last part is the notarization of the signatures of the guardians at a notary office, which can be either by similarity or by authenticity (I suggest authenticity). An interesting tip is to contact the hotel beforehand and ask if the establishment uses any specific accommodation authorization form. This way, you avoid any risk of refusal at check-in due to the authorization.
